Our whistleblowing process ensures that all concerns are addressed and investigated appropriately. Individuals who report in good faith will be protected from retaliation.

Acting in Good Faith

At HPH Group, we expect all whistleblowing reports to be made in good faith and based on reasonable grounds. Reports made with malicious intent or knowingly false information may lead to disciplinary action, including legal consequences where appropriate.

​HPH Group strictly prohibits any form of retaliation against individuals who report wrongdoing in good faith. Anyone found retaliating will be subject to appropriate disciplinary actions, including legal action where applicable. We are also committed to safeguarding whistleblowers. You may choose to report anonymously, and we will take all reasonable steps to protect your identity and ensure your trust and safety.

1. What is “Whistleblowing”?

Whistleblowing is the act of reporting any misconduct, unethical behavior or wrongdoing within the company to protect the organisation and its people.

2. What is a “Wrongdoing”?
HPH defines “Wrongdoing” as a wrongful, improper or unlawful conduct committed by relevant parties. Wrongdoing includes but not limited to :-

  • Fraud

  • Misappropriation of assets

  • Sexual harassment

  • Criminal breach of trust

  • Illicit and corrupt practices

  • Questionable or improper accounting 

  • Misuse of confidential information

  • Deliberate actions conflicting with the interests of the Company, violate laws or regulations, or go against established public policies.

  • Providing false or misleading information (including suppression of any material facts or information)

  • Breaches of any Group policies and Code of Conduct (COC)

  • The deliberate concealment of any of the above matters or other acts of wrongdoing 

3. If I am not sure whether certain actions or conducts are considered as Wrongdoing, should I still report it?

Yes. You are encouraged to report it. If you are unsure, it’s beter to raise the concern in good faith and not related to any personal complaints or HR-related matters. The report will be reviewed and directed promptly.

4. Will I be protected from retaliation?

Yes. You are protected from retaliation if you report in good faith.  The company prohibits any form of retaliation and will maintain confidentiality as much as possible.

5. What is defined as acting in ‘good faith’?
Acting in ‘good faith’ means reporting a concern honestly, based on what you genuinely believe to be true, even if it turns out to be incorrect. It does not mean you need to have proof, but your report must not be made with malicious intent, personal gain or harm others.

6. What happens if I report a concern, but the investigation finds no wrongdoing? will I face any consequences?

No. You will not face any consequences if you reported the concern in good faith. Whistleblowers are protected, even if the report turns out to be unsubstantiated. However, knowingly making false or malicious report may result disciplinary action.

7. Will my identity be kept confidential if I report a concern?

Yes. Your identity will be kept confidential to the extent possible and only shared with those directly involved in handling the report. The company takes confidentiality seriously to protect whistleblowers from retaliation or undue exposure. If disclosure is necessary for investigation purposes (i.e. by regulatory authorities), your consent will be sought. Please note that withholding consent may affect the investigation.

8. How do I report a Wrongdoing under the Whistleblowing Policy?

9. Can I withdraw my complaint if I made a mistake?
Yes, you can. Kindly forward your request via the channels that you have submitted your original complaint stating reasons for withdrawal.

10. What will happen to my complaint report when it is lodged?

Once your report is received, it will be reviewed to determine if it falls under the scope of whistleblowing. If it does, an investigation will be initiated by the designated team or authority. Throughout the process, confidentiality will be maintained, and appropriate actions will be taken based on the investigation findings.

11. Will I be involved in the investigation when I report a Wrongdoing?

You may be involved if additional information or clarification is needed to support the investigation. However, your involvement will be limited and handled with confidentiality. The investigation will be conducted by the designated team or authority.

12. What if I am not satisfied with the outcome of the investigation?
The ability to prove an alleged Wrongdoing in any investigation is dependent on the information and evidence provided. As such, not all investigations will provide satisfactory outcomes to all stakeholders. All concerns will be reviewed objectively, but please note that decisions are made based on available evidence and in accordance with company policies and procedures. If you are not satisfied with the outcome, you may wish to provide the investigation team with more evidence and information (if available) for them to proceed further towards a more satisfactory outcome.
